Help Needed – Judge Patent Moot Court

Every year my introductory patent law class holds a moot court tournament as a capstone experience. The students research the issues and write briefs (and responsive briefs) and then we have oral arguments.  We also have a $ponsor (the McKool Smith firm) and so the winner gets $1,000.

I need a few more judges for rounds on November 15, 2022 (via ZOOM). Please only sign up if you are an attorney (or retired attorney) with experience in the patent space.

There are three time slots:

  • 4-7 pm (Judge 3 rounds);
  • 5-7 pm (Judge 2 rounds);
  • 7:45 -8:45 (Championship round)

This year’s case is based upon a recent decision in Philips v. Fitbit. The district court found for the defendant on both eligibility and indefiniteness.  Patentee is appealing on both grounds.  Before the competition, I’ll send around a Judge’s Brief that includes more details and potential questions.  If you are not available, please forward the request to others who you think might be great judges.  I’m working on CLE approval, but it will probably only be for Missouri lawyers.  Patents in suit: US6013007.pdf; US8277377.pdf.
